Adoption of development plans
268ZJ Adoption of development plans
(1) A development plan is adopted by an
authority if--
(a) the authority resolves to adopt the plan or takes such
other action as is necessary to take the decision to adopt the plan, and
(b)
the authority publishes notice of the adoption of the plan on the NSW planning
portal within 28 days after the decision of the authority to adopt the plan.
(2) An authority must not adopt a development plan unless it is satisfied that
the consent of the owners, as referred to in clause 3(2)(g) of Schedule 7 to
the Act, has been obtained in relation to that plan.
(3) A development plan
that is adopted by an authority is taken to be in force in relation to the
subdivision land for the purposes of clause 4(5) of Schedule 7 to the Act.
