(1) The maximum fee payable for an application involving extractive industry (not being mining) is the sum of the following--(a) $5,660, plus $0.06 for each tonne of material that is to be extracted annually,(b) if the application involves the erection of a building--the maximum fee calculated in accordance with clause 256F in relation to the erection of a building.
(2) For the purposes of subclause (1), the Planning Secretary is to determine the weight of material that is to be extracted annually by reference to a genuine estimate of the average annual weight of material intended to be extracted.
