Determination of fees
256E Determination of fees
(1) The determination of a fee to accompany an
application for State significant development must be made before, or within
14 days after, the consent authority receives the application.
(1A) The
determination of a fee to accompany an application for State significant
infrastructure must be made before, or within 14 days after, the proponent
submits an environmental impact statement to the Planning Secretary under the
Act, section 5.17(1).
(2) A determination has no effect until notice of the
determination is given to the applicant by means of the NSW planning portal.
(3) The Minister may refuse to consider an application for which a fee has
been duly determined and notified to the applicant but remains unpaid.
