ENVIRONMENTAL PLANNING AND ASSESSMENT (SAVINGS AND TRANSITIONAL) REGULATION 1998 - REG 59

59 Building certificates

(1) Anything done before the appointed day under Part 4 of Chapter 7 of the unamended LG Act 1993 is taken to have been done under sections 149A- 149G of the amended EP&A Act 1979, but only to the extent to which it could have been done under those sections had those sections been in force when it was done.

(2) In particular:

(a) a building certificate issued before the appointed day under section 172 of the unamended LG Act 1993 is taken to be a building certificate issued under sections 149A- 149D of the amended EP&A Act 1979, and

(b) records kept by a council under section 174 of the unamended LG Act 1993 are taken to be records kept by the council under section 149G of the amended EP&A Act 1979.
