Development within mine subsidence districts
47 Development within mine subsidence districts
(1) The Council shall not grant consent to development on land within a mine
subsidence district except with the concurrence of the Mine Subsidence Board.
(2) In determining whether to grant concurrence under subclause (1), the Mine
Subsidence Board shall have regard to: (a) whether the proposed development is
likely to conflict with the future extraction of coal, and
(b) whether the
proposed development is under threat of subsidence.
