Development along main roads
19 Development along main roads
(1) The Council shall not grant consent to an application to develop land
which has frontage to a main road, unless, in the opinion of the Council: (a)
access to that land is provided by a road other than the main road, wherever
practicable, and
(b) the safety and efficiency of the main road will not be
adversely affected by the development of that land for that purpose, by reason
of: (i) the design of the access to that land,
(ii) the emission of smoke or
dust from that land, or
(iii) the nature, volume or frequency of vehicles
turning to and from the main road to the access to that land.
(2) The Council
shall not consent to the development of land in Zone No 1 (a), for a purpose
listed in Schedule 2 if the development of the land for that purpose will have
direct access to a main road or to a road connecting to a main road, and the
access to that road is within 90 metres (measured along the road alignment of
the connecting road) of the alignment of the main road.
