Heritage advertisements and notifications
29 Heritage advertisements and notifications
(1) Except as provide by subclause (2): (a) the provisions of sections 84, 85,
86, 87 (1) and 90 of Act apply to and in respect of the demolition of a
building or work that is a heritage item in the same way as those provisions
apply to and in respect of designated development, and
(b) where a person
makes a development application to demolish a building or work that is a
heritage item, the Council shall not consent to that application until 28 days
after the Council has notified the Secretary of the Heritage Council of its
intention to do so.
(2) Subclause (1) does not apply to the partial
demolition of a heritage item if, in the opinion of the Council, the partial
demolition will not adversely affect the heritage significance of the heritage
item in relation to the environmental heritage of the Shire of Barraba.
