New South Wales Consolidated Acts New South Wales Consolidated ActsIn any proceedings brought against a person for an offence against this Act or the regulations in which it is alleged that the premises to which the offence relates were a residential centre for handicapped persons at any time by reason of an order in force under section 3A, the premises shall be deemed not to have been a residential centre for handicapped persons at that time if the person satisfies the court:
(a) that no, or only one, handicapped person resided at the premises at that time, or
(b) that all of the handicapped persons who resided at the premises at that time resided there with a relative of them who was of or above the age of 18 years but not a handicapped person.
