WITNESS PROTECTION ACT 1995 - SECT 38
Provision of information to approved authorities
38 Provision of information to approved authorities
(1) If: (a) a witness has been provided with a new identity or relocated under
this Act, and
(b) an approved authority notifies the Commissioner of Police
that the witness is under investigation for, or has been arrested for or is
charged with, an offence against a law of New South Wales, the Commonwealth,
another State or a Territory, the maximum penalty for which is or includes
imprisonment for a period of more than one year,
the Commissioner of Police
may do any one or more of the things in subsection (2).
(2) If subsection (1)
applies, the Commissioner of Police may: (a) release to the approved authority
the new identity or location of the witness,
(b) provide the
approved authority with the criminal record and the fingerprints of the
witness,
(c) release to the approved authority such other information
relating to the witness as the Commissioner of Police considers appropriate in
the circumstances,
(d) if the Commissioner of Police considers it appropriate
in the circumstances, allow officers of the approved authority to interview
members of the Police Service in relation to the witness.
