WATER MANAGEMENT ACT 2000 - SECT 289
Area of operations
(1) The area of operations of a water supply authority is such as may be
prescribed by the regulations for the water supply authority.
(2) If a
regulation so provides, a water supply authority has, and may exercise, in its
area of operations or a specified part of its area of operations: (a) only
such of the functions of a water supply authority as are specified in the
regulation, or
(b) all functions of a water supply authority other than
functions specified in the regulation.
(3) A regulation made for the purposes
of subsection (2) may make provision for or with respect to: (a) matters
affecting revenue, assets, rights, liabilities and employees of a water supply
authority, and
(b) procedures to be adopted for the purposes of paragraph
(a).
(4) Within the area of operations of a water supply authority, a
function under this Part may be exercised only by the water supply authority
unless: (a) the function is exercisable by the Minister, or
(b) the function
is exercised by a catchment management authority under the
Catchment Management Authorities Act 2003 , or
(c) with the consent of the
Minister, the function is exercised by another Minister, by the delegate of
another Minister or by a statutory body, or
(d) this Part provides otherwise.
(5) With the consent of the Minister, a water supply authority may exercise a
function outside its area of operations.
(6) Until a regulation is made for
the purposes of subsection (1), the area of operations of a water supply
authority is the same as it was immediately before the commencement of this
Part.
