WESTERN LANDS ACT 1901 - SECT 35Q
Minister may dedicate public roads
35Q Minister may dedicate public roads
(1) The Minister may, by notice published in the Gazette, withdraw from lease,
for the purpose of its being dedicated as a public road, any land that, in the
Minister’s opinion, is being used by the public as a road.
(2) Having
withdrawn land from lease by means of a notice referred to in subsection (1),
the Minister may, pursuant to section 12 of the Roads Act 1993 , dedicate that
land as a public road.
(3) No compensation is payable to any person with
respect to any loss or damage arising from the operation of this section.
(4)
This section applies to land comprised in a lease granted or issued before the
commencement of this section, but does not apply to a lease granted or issued
after that commencement.
