WESTERN LANDS ACT 1901 - SECT 28BA
Forfeiture of lease
28BA Forfeiture of lease
(1) If, in relation to a lease granted under section 28A before or after the
insertion of this section by the Western Lands (Amendment) Act 1989 , the
Minister determines: (a) that the land comprised in the lease is not used or
occupied in good faith for the purpose for which the lease is in force, or
(b) that a condition of the lease has not been complied with,
the lease is
liable to be forfeited.
(2) Except to the extent, if any, that the Minister
otherwise directs, forfeiture of a lease to which this section applies
includes forfeiture of any improvements made and rent paid.
