Non-assignability of compensation
235 Non-assignability of compensation
(cf 1926 s 55; 1987 s 273)
(1) Compensation under this Act (including
the 1987 Act and the former 1926 Act)-- (a) is not capable of being assigned,
charged or attached, and
(b) does not pass to any other person by operation
of law,
nor can any claim be set off against that compensation.
(2)
Subsection (1) has no effect to the extent to which (but for this subsection)
it would operate to prevent-- (a) the satisfaction of an obligation by the
worker to maintain another person pursuant to an order of a court of competent
jurisdiction, or
(b) the passing of accrued vested rights of a deceased
worker to the legal personal representative.
