Cancellation of approvals
178 Cancellation of approvals
(1) Where the Ministerial Corporation is satisfied that a controlled work in
respect of which an approval is in force does not comply with the approval, or
with any condition imposed on the approval, the Ministerial Corporation may
cause to be served on the occupier of the land upon which the work is situated
a notice to the effect that, at the expiration of the period of 28 days next
following service of the notice, the approval will be cancelled.
(3) At the
expiration of the period referred to in subsection (1), an approval in respect
of which a notice has been served under that subsection and has not been
withdrawn shall, unless the approval is the subject of an appeal under section
178A, be deemed to be cancelled.
(4) Where an approval is deemed to be
cancelled under this section, the Ministerial Corporation may cause notice of
the cancellation to be published in the Gazette, and any such notice shall be
conclusive evidence of the cancellation.
