Production of documents to Valuer-General
15A Production of documents to Valuer-General
(1) The Valuer-General may, by notice in writing served: (a) on any person who
is the owner of any land, or
(b) if the owner is not resident in the State,
on any person who is the agent or attorney of the owner,
require the person to
produce to the Valuer-General, within a time specified by the Valuer-General
in the notice, such documents relating to the land as may be required by the
Valuer-General for the purposes of this Act and as may be specified in the
notice, whether generally or otherwise.
(2) Without limiting the generality
of subsection (1), a notice referred to in that subsection may require the
production of: (a) any contract, or a copy of any contract, for the purchase
of the land, any instrument incorporated or referred to in any such contract
and any instrument or option relating to the purchase of the land by the
owner, where the contract, copy, instrument or option is in the owner’s
possession or under the owner’s control, or
(b) any financial or accounting
document or record specified in the notice relating to the conduct by the
owner of any business or activity on the land where the document or record is
in the owner’s possession or under the owner’s control.
(4) A person who
neglects or refuses to comply with the requirements of a notice served on the
person under this section shall be liable to a penalty not exceeding 2 penalty
units.
