Revocation of interim declaration
23 Revocation of interim declaration
(1) The Local Court may revoke an interim declaration made by the court if:
(a) an application for the revocation of the interim declaration is made to
the court, and
(b) the applicant is able to satisfy the court that the
premises the subject of the interim declaration were not gambling premises at
the date of filing the affidavit that led to the making of the interim
declaration.
(2) The revocation of an interim declaration may be subject to
such conditions as the Local Court thinks fit, including conditions relating
to the giving of undertakings to ensure that the premises will not be used as
gambling premises.
(3) The revocation of an interim declaration has effect
from the date of the court’s decision to revoke the interim declaration, or
such other date as the court may specify.
