TOW TRUCK INDUSTRY ACT 1998 - SECT 33
Investigation of application for licence or drivers certificate
(1) The RTA may carry out such investigations and inquiries as the RTA thinks
necessary to enable it to properly consider an application for a licence or
drivers certificate.
(2) In particular, the RTA may: (a) require any person
who is an applicant for a licence or drivers certificate, or who is a
close associate of the applicant, to consent to having his or her photograph
taken in accordance with the arrangements determined by the RTA, and
(b)
refer to the Commissioner of Police details of any person the RTA is
investigating, copies of any photographs taken and any supporting information
that the RTA considers appropriate for referral to the Commissioner.
(3) The
Commissioner of Police may inquire into and report to the RTA on such matters
concerning the application as the RTA may request.
(4) The RTA may refuse to
consider an application for a licence or drivers certificate while any person
from whom the RTA requires a photograph under this section refuses to allow
his or her photograph to be taken in accordance with this section.
(5) For
the purposes of this section and section 34, a person who is the holder of a
licence or drivers certificate (
"the current licence or drivers certificate") is taken to have applied for a
subsequent licence or drivers certificate if: (a) the RTA has, before
the current licence or drivers certificate is due to expire, given that person
notice that the current licence or drivers certificate is due to expire, and
(b) the person does not, within the time specified in the notice, notify the
RTA that the person does not intend to apply for a subsequent licence or
drivers certificate.
