Suspension of officers from duty pending decision in relation to misconduct or criminal conviction
93L Suspension of officers from duty pending decision in relation to
misconduct or criminal conviction
(1) If an allegation that an officer has engaged in misconduct is being dealt
with as a disciplinary matter in accordance with the procedural guidelines,
the Director-General may suspend the officer from duty until the allegation of
misconduct has been dealt with.
(2) If an officer is charged with: (a) an
offence referred to in section 93K, or
(b) an offence that would, on
conviction, result in the officer being a prohibited person as referred to in
Part 4B,
the Director-General may suspend the officer from duty until the
officer is notified by the Director-General that the suspension has been
lifted.
(3) Any salary payable to a person as an officer while the person is
suspended from duty under this section is (if the Director-General so directs)
to be withheld.
(4) The salary withheld under subsection (3) is forfeited to
the State unless the Director-General otherwise directs or that salary was due
to the person in respect of a period before the suspension was imposed.
