38 Delegations
(1) The Secretary may delegate to an authorised delegate any of the
Secretary's functions under this Act or the regulations, other than this power
of delegation.
(2) The Commissioner may delegate to an authorised delegate
any of the Commissioner's functions under this Act or the regulations, other
than this power of delegation.
(3) A delegate may sub-delegate to another
authorised delegate any of the functions delegated by the Secretary or the
Commissioner if the delegate is authorised in writing to do so by the
Secretary or Commissioner (as the case requires).
(4) In this section--
"authorised delegate" means-- (a) a police officer or any other member of the
NSW Police Force, or
(b) a person employed in a Public Service agency within
the meaning of the Government Sector Employment Act 2013 , or
(c) any person
(or any person belonging to a class of persons) prescribed by the regulations.
