TERRORISM (POLICE POWERS) ACT 2002 - SECT 26J
Terms of preventative detention orders
26J Terms of preventative detention orders
(1) A preventative detention order must set out: (a) the name of the person
authorised to be detained under the order, and
(b) the period for which the
person is authorised to be detained (not exceeding the period provided by this
Part), and
(c) the date on which, and the time at which, the order is made,
and
(d) the date and time after which the person may not be taken into
custody under the order (not exceeding 48 hours after the order is made), and
(e) a summary of the grounds on which the order is made.
(2) To avoid doubt,
subsection (1) (e) does not require information to be included in a summary if
the disclosure of the information is likely to prejudice national security
(within the meaning of the National Security
Information (Criminal and Civil Proceedings) Act 2004 of the Commonwealth).
