TIMBER MARKETING ACT 1977 - SECT 9
Sale of articles
(1) A person shall not sell an article having lyctid susceptible sapwood.
(2)
It is a defence to a prosecution brought in respect of an offence under
subsection (1) if the defendant proves that: (a) the defendant did not know
and could not reasonably be expected to have known that the article had
lyctid susceptible sapwood,
(b) before the completion of the sale of that
article the defendant gave the purchaser a written statement to the effect
that sapwood liable to attack by lyctids was included in that article, or
(c)
the completion of the first sale of that article after the inclusion in it of
the lyctid susceptible sapwood occurred more than 2 years before the date on
which that prosecution was commenced.
