TECHNICAL AND FURTHER EDUCATION COMMISSION ACT 1990 - SECT 22U
Offences and prohibited person status to be notified to appropriate Division Head
22U Offences and prohibited person status to be notified to
appropriate Division Head
(1) A member of staff who: (a) is charged with a serious sex offence, the
murder of a child or a child-related personal violence offence, or
(b) who
becomes a prohibited person,
must immediately report that fact to the
appropriate Division Head.
(2) On becoming aware of the fact that a
member of staff has been charged with an offence referred to in subsection
(1), or is a prohibited person, the person in charge of the TAFE establishment
at which the member is employed must also immediately report that fact to the
appropriate Division Head.
(3) The requirement to report to the
appropriate Division Head under this section does not apply if the matter has
already been reported under section 21B.
(4) In this section,
"child-related personal violence offence" and
"serious sex offence" have the same meanings as in Division 2 of Part 7 of the
Commission for Children and Young People Act 1998 .
