(1) The regulations may make provision for or with respect to the employment
of persons in the Transport Service, including conditions of employment and
disciplinary matters.
(2) Any such regulations have effect--
(a) despite any
determination of the Transport Secretary under this Part, and
(b) except in
the case of Transport Service senior executives or senior managers--subject to
any relevant award made by a competent industrial tribunal and to any
industrial agreement to which the Transport Secretary is a party.
