Note : The regulations also provide for
the termination of the employment of members of the Transport Service senior
executive on disciplinary grounds.
(2) A Transport Service senior executive
or senior manager whose employment is terminated under this section is
entitled to such compensation (if any) as may be provided in the contract of
employment of the executive or manager (and to no other compensation or
entitlement for the termination of employment other than superannuation
entitlements).
(3) A Transport Service senior executive or senior manager
whose employment is so terminated is not to be employed in the public sector
during the period specified in the contract of employment to which any such
compensation relates unless arrangements have been made for a refund of the
proportionate amount of the compensation.
(4) The regulations under the
Government Sector Employment Act 2013 may make provision relating to the
calculation of the proportionate amount of a payment to be refunded under
subsection (3).
(5) A Transport Service senior executive or senior manager
whose employment is terminated under the provisions of the regulations under
this Part (or other statutory provisions) relating to the termination of the
employment of persons employed in the Transport Service in connection with
disciplinary action is not entitled to compensation under this section. Those
provisions do not apply to a termination of employment under this section.
