Offence to discharge into works
64 Offence to discharge into works
(1) A person must not discharge any substance into a work owned by or under
the control of the SCA except with the written agreement of the SCA. Maximum
penalty: (a) in the case of a corporation-$250,000 and, in the case of a
continuing offence, a further penalty of $30,000 for each day the offence
continues, or
(b) in the case of an individual-$120,000 and, in the case of a
continuing offence, a further penalty of $15,000 for each day the offence
continues.
(2) This section does not apply to the use of a work by a person
in accordance with a contract or arrangement between the SCA and a person.
