STRATA SCHEMES MANAGEMENT ACT 1996 - SECT 135
Notice of application to be given
135 Notice of application to be given
(1) The Registrar must give a copy of
an application for an order under this Chapter to the owners corporation for
the strata scheme to which the application relates and to any other person,
not being the applicant, who, in the Registrar’s opinion, would be affected
if the order sought were made.
(2) The copy of the application must be
accompanied by a notice stating that the person to whom the notice is given
may make a written submission to the Registrar within a time specified in the
notice, or within a longer time specified in any further notice given by the
Registrar.
(3) The Registrar must give a notice to the applicant for the
order stating that the applicant may make further written submissions to the
Registrar within a time specified in the notice, or within a longer time
specified in any further notice given by the Registrar.
(4) The Registrar may
extend the time for the making of submissions by a further notice given to
each of the persons to whom the original notice was given.
(5) Subsections
(2)-(4) do not apply to an application for an order under Part 6 (Enforcement
of orders of Adjudicators and Tribunal and certain notices).
