STRATA SCHEMES DEVELOPMENT ACT 2015 - SECT 99
Requirement to register strata management statement
(1) The Registrar-General must not register a plan as a strata plan that
creates a part strata parcel unless the Registrar-General also registers a
strata management statement for the building and its site or waives, under
subsection (2), the requirement for a strata management statement.
(2) The
Registrar-General may waive the requirement for a
strata management statement-- (a) if-- (i) the building is erected on a lot in
a community scheme, and
(ii) only part of the building and site is to be
subdivided by a strata plan, and
(iii) all of the residue of the building and
site is to be community property within the meaning of the Community Land
Management Act 2021 , or
(b) if-- (i) the plan relates to part of a building
that includes one or more part strata parcels, and
(ii) a
strata management statement has already been registered for the building and
its site, or
(c) if a registered building management statement is in force
for the building and its site, or
(d) if the Minister, on the grounds the
Minister considers sufficient, directs.
