Meaning of “control” of a record
6 Meaning of “control” of a record
(1) For the purposes of this Act, a person is taken to have control of a
record if the person has possession or custody of the record or has the record
in the possession or custody of some other person.
(2) For the purposes of
this Act, an entitlement to control of a record is an entitlement to
possession and custody of the record (including by having it in the possession
or custody of some other person).
Note: For example, a public office is taken
to have control of records that are held by the public office in storage with
a commercial storage provider.
