Open access period for records

50 Open access period for records

For the purposes of this Act, a State record is
"in the open access period" if the record is at least 30 years old. A record is taken to be 30 years old when 30 years have elapsed since it came into existence or since the original record of which it is a copy came into existence.

Note : The fact that a record is in the open access period does not automatically mean that it is open to public access under this Act. Generally the record must be the subject of an open to public access direction (given by the public office responsible for the record) before it is open to public access. There is a presumption that a State record in the open access period should be open to public access but the public office responsible for the record can close the record to public access by giving a closed to public access direction (a CPA direction).
