Proceedings for offences
60 Proceedings for offences
(1) Proceedings for an offence against this Act or the regulations may be
dealt with summarily before the Local Court or before the Supreme Court in its
summary jurisdiction.
(2) If proceedings for an offence are brought before
the Local Court, the maximum monetary penalty that the Court may impose is 100
penalty units or the maximum monetary penalty provided by this Act or the
regulations in respect of the offence, whichever is the lesser.
(3) If
proceedings for an offence are brought before the Supreme Court, the Court may
impose a penalty not exceeding the maximum penalty provided by this Act or the
regulations in respect of the offence.
(4) Any such proceedings commenced in
the Local Court must be commenced by an information laid within 12 months
after the time when the offence is alleged to have been committed.
