Misrepresentation and related offences
33 Misrepresentation and related offences
(1) A licensee must not: (a) by any false, misleading or deceptive statement,
representation or promise, or
(b) by any wilful concealment of a material
fact,
induce, or attempt to induce, any person to enter into an agreement or
contract in connection with the carrying on of any security activity. Maximum
penalty: (a) in the case of a corporation-200 penalty units, or
(b) in the
case of an individual-100 penalty units or imprisonment for 6 months, or both.
(2) A person must not: (a) in relation to any application for the purposes of
this Act or the regulations, or
(b) in relation to any information or
particulars that the person is required to furnish under this Act or the
regulations,
make any representation or statement that the person knows is
false or misleading in a material particular. Maximum penalty: 50 penalty
units.
