16A Restrictions on granting licence-conflict of interest for police officers
(1) The Commissioner must refuse to grant an application for a licence to a
police officer or other member of the NSW Police Force if the Commissioner
considers that the grant of the licence, or the carrying on of the security
activities authorised by the licence, would create a conflict of interest
between the proper performance of the officer’s or member’s duties as an
officer or member and the officer’s or member’s private interests.
(2)
However, the Commissioner may grant an application for a licence to a police
officer or other member of the NSW Police Force subject to the condition that
the person may not be employed by specified persons, if to do so would avoid a
conflict of interest of the kind described in subsection (1). This subsection
does not limit the other conditions to which a licence may be subject.
