Authority not to issue or renew licence in certain circumstances
9 Authority not to issue or renew licence in certain circumstances
(1) The
Authority must not issue a driver licence to a person unless it is satisfied
that the person is a resident of this State and that: (a) the person is
eligible to be issued with, or to apply for, the driver licence, and
(b) if
the person is the holder of an Australian driver licence or a licence to drive
a motor vehicle in a foreign country, that licence has been surrendered,
in
accordance with the regulations.
(2) However, the Authority may issue a
driver licence to a person without the person surrendering the person’s
licence to drive a motor vehicle in a foreign country in circumstances
prescribed by the regulations.
(3) The Authority must not renew a driver
licence of a person if it is satisfied that the person is no longer a resident
of this State.
(4) Subsections (1) and (3), to the extent that they require a
person to be a resident of this State, do not apply to a person who resides
temporarily outside this State.
(5) This section does not limit the other
circumstances in which the Authority may refuse to issue or renew a licence.
