(1) A court may award costs in relation to the proceedings for an order under this Division.
(2) A court may, in proceedings for an order under this Division, order payment of any costs or expenses incurred in weighing a freight container or any of its contents or both, where:(a) the minimum weight stated in the container weight declaration concerned was lower than the actual weight, or(b) a container weight declaration was not provided.
(3) An order under subsection (2) may be made in favour of a party to the proceedings, an Australian Authority or a public authority of this or any other jurisdiction.
