Agreements to be in standard form
9 Agreements to be in standard form
(1) If a standard form of residential tenancy agreement is prescribed, a
residential tenancy agreement for which a form is prescribed and which is
entered into on or after the day the form is prescribed, or any later day
prescribed for the purpose, shall be in or to the effect of the form.
(2)
Except as provided by section 10, a residential tenancy agreement for which a
standard form is prescribed is void to the extent to which it is not in or to
the effect of the form.
(3) Except as provided by this Act, the terms
contained in a prescribed standard form of residential tenancy agreement shall
not be varied by the parties to a residential tenancy agreement for which the
form is prescribed and to the extent that they are so varied shall be deemed
not to have been varied.
(4) Nothing in subsection (2) or (3) voids a right
to occupy residential premises that is granted by a
residential tenancy agreement referred to in those subsections.
