Application of Division
44 Application of Division
(1) This Division applies to a rent increase even though the amount of the
rent increase, or a method for calculating the amount of the increase, is set
out in a residential tenancy agreement.
(2) An increase in the amount payable
by a tenant because of the cancellation or reduction of a rent rebate is not a
rent increase for the purposes of this Division, and such a cancellation or
reduction does not constitute a withdrawal of goods, services or facilities as
mentioned in section 47. Note: However, a social housing tenant may apply to
the Tribunal for an order that rent is excessive under section 47A if the
rent rebate of the tenant is cancelled.
