135 Appointment
(1) The Regulator may, by instrument in writing, appoint a person, or a person
of a prescribed class, to be a rail safety officer for a term, and subject to
the conditions, specified in the instrument.
Notes :
1 A person appointed
under subsection (1) need not be an employee of a government agency or
instrumentality.
2 A person appointed under subsection (1) may be a police
officer of a participating jurisdiction.
(2) Without limiting the conditions
to which the appointment of a rail safety officer may be subject, a condition
may specify 1 or more of the following--
(a) functions under this Law that may
not be exercised by the officer;
(b) the only functions under this Law that
may be exercised by the officer;
(c) the circumstances or manner in which a
function under this Law may be performed by the officer.
