101 Compliance with safety management system
(1) A rail transport operator must implement the operator's safety management
system.
: Maximum penalty--
(a) in the case of an individual--$150 000;
(b)
in the case of a body corporate--$1 500 000.
(2) A rail transport operator
must not, without reasonable excuse, fail to comply with the operator's safety
management system for the operator's railway operations.
: Maximum penalty--
(a) in the case of an individual--$150 000;
(b) in the case of a body
corporate--$1 500 000.
(3) Subsection (2) places an evidential burden on the
accused to show a reasonable excuse.
