Board protected in certain cases
67 Board protected in certain cases
(1) If, before receiving notice of a claim to any payment for any of the
commodity vested in a board or to the chose in action or any part thereof the
subject-matter of any such payment, the board has in good faith and without
negligence made that payment, in whole or in part, in accordance with the
provisions of this Division, the board shall not, to the extent to which it
has made that payment, incur any liability to the true owner of the commodity
or chose in action or any part thereof or to any person claiming through,
under or in trust for the true owner.
(2) This section does not in any way
prejudice or affect any rights inter se of any parties claiming adversely to
one another to be entitled whether at law or in equity to the commodity or
chose in action the subject-matter or part of the subject-matter of any claim
for payment.
(3) In any proceedings taken in any court by any such person in
respect of any such commodity or chose in action or part, the board may plead
this section as a defence to the proceedings.
