Function to be exercised in accordance with relevant function management plan
49 Function to be exercised in accordance with relevant function management
plan
(1) Any function of the authority for which there is a function management
plan must as far as practicable be exercised in accordance with the function
management plan.
(2) The exercise of that function is not invalid because of
a contravention of any such plan. However, this subsection does not prevent
the State Council from exercising its powers under section 27 in respect of
the function.
(3) In the event of an inconsistency between a function
management plan and a memorandum of understanding entered into under section
13 (1) (or an instrument issued under such a memorandum of understanding), the
memorandum of understanding (or instrument) prevails to the extent of the
inconsistency.
