13 Costs before fit-out
(1) This section applies if a lessee of a retail
shop is liable to pay an amount for, or associated with, any works carried out
by or on behalf of the lessor (before or after the lease is entered into) to
enable the proposed fit-out of the shop by the lessee.
(2) The maximum amount
of the costs of the works, or a basis or formula with respect to those costs,
is to be agreed in writing by the lessor and lessee before the lease is
entered into.
(3) The lessee is not liable to pay an amount in respect of the
works that is more than the agreed maximum amount.
