RURAL FIRES ACT 1997 - SECT 33C
Search warrants
33C Search warrants
(1) The Commissioner may apply to an authorised officer
for a search warrant for any land if the Commissioner reasonably believes that
entry onto the land is necessary for the purposes of the investigation of the
cause or origin of any fire that has occurred on that land or any adjacent
land.
(2) An authorised officer to whom an application is made may, if
satisfied that there are reasonable grounds for doing so, issue a search
warrant authorising the Commissioner or any other person named in the warrant
to enter land for the purposes of the investigation of the cause or origin of
any fire that has occurred on that land or any adjacent land.
(3) Division 4
of Part 5 of the Law Enforcement (Powers and Responsibilities) Act 2002
applies to a search warrant issued under this section.
(4) In this section:
"authorised officer" has the same meaning as in the
Law Enforcement (Powers and Responsibilities) Act 2002 .
