General powers of rural fire brigade officers and others
22 General powers of rural fire brigade officers and others
(1) An officer
of a rural fire brigade or group of rural fire brigades of a rank designated
by the Commissioner may, for the purpose of controlling or suppressing a fire
or protecting persons, property or the environment from an existing or
imminent danger arising out of a fire, incident or other emergency: (a)
exercise any function conferred on the officer by or under this Act, or
(b)
take any other action that is reasonably necessary or incidental to the
effective exercise of such a function.
(2) The officer may exercise such a
function or take such an action with such persons as the officer considers
necessary for the purpose.
(2A) Any function that may be exercised, or action
that may be taken, by an officer of a rural fire brigade or group of rural
fire brigades because of this section may be exercised or taken by the
Commissioner.
(3) The following provisions of this Division are intended to
be particular examples of the way in which functions referred to in this
section can be exercised and are not intended to limit the generality of this
section.
