RADIATION CONTROL ACT 1990 - SECT 39
Exemptions
39 Exemptions
(1) The regulations may make provision for exemptions (whether or not subject
to conditions) from compliance with all or specified provisions of this Act
and the regulations, including provision: (a) authorising the Minister to
grant such an exemption, and
(b) specifying circumstances in which an
exemption granted under any law of another State, a Territory or the
Commonwealth is to be considered to be an exemption granted under the
regulations.
(2) The Minister may grant an exemption authorised by the
regulations for such period as is determined by the Minister.
(3) Before
granting an exemption authorised by the regulations for a period exceeding 60
days, the Minister must seek, and take into consideration, the advice of the
Council about the proposed exemption.
