Increased penalty for offence causing serious harm
24 Increased penalty for offence causing serious harm
(1) This section applies when a person is convicted of an offence under
section 6, 7, 8 or 19 and it is proved beyond reasonable doubt that the
person, or a person involved in the commission of the offence, knew that its
commission was likely to cause serious harm to a person, animal or thing or
the environment by exposure to radiation.
(2) When this section applies, the
maximum penalty that may be imposed in respect of the offence concerned is
increased to 10,000 penalty units in the case of a corporation or 1,500
penalty units or imprisonment for 2 years, or both, in any other case.
