37 Resolution when to be sufficient authority for execution of works etc
(1) Every resolution of the Legislative Assembly declaring that it is
expedient to carry out the work specified or mentioned in such resolution
shall be deemed to impose a statutory duty on the Minister to introduce a Bill
into the said Assembly to sanction the carrying out of such work, upon the
passing whereof by the Legislature and in such form as the Legislature may
think fit, the authorisation of such work shall become absolute, and the
Constructing Authority shall thereupon carry out such work, enter into such
contracts, and take all such necessary steps for the proper execution thereof
as such Authority may think proper.
Provided that no such contracts shall exceed in the aggregate by more than ten
per centum the estimate for the same submitted as hereinbefore provided.
(2)
Where the Governor has: (a) pursuant to subsection two or six of section
thirty-four of this Act directed that a work shall be carried out under this
Act, the Constructing Authority, or
(b) pursuant to subsection three or four
of section thirty-four of this Act directed that a work shall be carried out
under this Act, the Minister,
shall enter into such contracts and take all
such necessary steps for the proper execution thereof as such
Constructing Authority or Minister, as the case may require, may think proper.
