(c) finds the person in circumstances that lead,
or has information that leads, the officer reasonably to suspect the person
has committed such an offence.
(2) A person who--
(a) fails or refuses to
comply with the requirements of an authorised officer made under this section,
or
(b) in purported compliance with such a requirement, states a name that is
not his or her name or an address that is not his or her residential address,
is guilty of an offence.
: Maximum penalty--5 penalty units.
(3) A person is
not guilty of an offence under this section unless it is established that the
authorised officer--
(a) warned the person that a failure or refusal to comply
with the requirement is an offence, and
(b) identified himself or herself as
an authorised officer or, in the case of an authorised officer who is a police
officer, as a police officer.
(4) The authorised officer may also request the
person to provide evidence of the correctness of the stated name or required
address if the authorised officer reasonably suspects the stated name or
address is false.
