PASSENGER TRANSPORT ACT 1990 - SECT 46W
Appointment of authorised officers
(1) A regulator may appoint a member of staff of the regulator (or if the
regulator is TfNSW, a member of staff of TfNSW) or a person of a class
prescribed by the regulations, to be an authorised officer for the purposes of
this Act.
(2) An authorised officer appointed by Roads and Maritime Services
may exercise the functions of an authorised officer under this Act only in so
far as those functions relate to any one or more of the following: (a) a
public passenger service carried on by means of a ferry,
(b) a person who
carries on a public passenger service by means of a ferry,
(c) the employees
of a person who carries on a public passenger service by means of a ferry.
(3) An authorised officer appointed by TfNSW may exercise the functions of an
authorised officer under this Act except in so far as those functions relate
to any of the matters set out in subsection (2).
(4) The authority of an
authorised officer may be limited by the relevant instrument of appointment to
the functions specified in the instrument of appointment.
(5) In addition to
other persons who may be appointed as authorised officers under this Act, a
regulator may, for the purposes of a specified bus or ferry accident or
incident, appoint as an authorised officer a person exercising powers, or
holding office under a Commonwealth Act.
