POLICE REGULATION (SUPERANNUATION) ACT 1906 - SECT 10A
Injury management program
10A Injury management program
(1) STC is not to commence to pay a benefit otherwise payable under section 10
in respect of a member of the police force if the Commissioner of Police
decides that a reasonable direction given to the member in respect of the
member’s participation in an injury management program has, as at the time
of the decision, not been complied with by the member.
(2) If the
Commissioner makes such a decision, the Commissioner must give written notice
of the decision to STC and to the member.
(3) The Commissioner must not so
decide unless: (a) the injury management program was approved by the
Commissioner as being no less beneficial to participants in the program than
any comparable injury management program under the Workplace Injury
Management and Workers Compensation Act 1998 applicable to members of the
police force, and
(b) the member failed to comply with a reasonable direction
given to the member in respect of the member’s participation in the program,
and
(c) the member was given a reasonable opportunity to comply, and
(d) the
member was warned in writing that failure to comply might result in the member
not receiving a benefit under this Act.
