Recovery of costs of lodging caveat
237B Recovery of costs of lodging caveat
(1) A person (including a public authority) who lodges a caveat in respect of
land to which a restraining order applies under section 237 may, by notice in
writing, require the defendant to pay all or any of the reasonable costs and
expenses incurred by the person in respect of the lodgment and registration of
the caveat (including the costs of withdrawal of the caveat).
(2) The person
may recover from the defendant any unpaid amounts specified in the notice as a
debt in a court of competent jurisdiction.
